Former football international and current Belgian senator, Mr. Marc Wilmots, creates a precedent in Belgian constitutional law. Mr. Wilmots wants to resign as a senator, but there isn’t anyone left to succeed him. He now wants to try a workaround. By refusing his salary as a MP he wants - only de facto - to resign as a senator, while officially still staying a senator.In 2003 Mr. Wilmots was elected in the Senate. His few activities as a senator can be found on the website of the Belgian Senate. He would allegedly prefer to pursue his career in football and would not be able to fulfill his obligations as a senator, except in extraordinary circumstances. But a resignation of the former player of Standard, Schalke (where he got his nickname) and player and former manager of St-Truiden, reveals impossible in practice, because there is no successor available. His party, the MR, has run out of successors. This would mean that the whole French speaking district of the Senate would have to be re-elected.The presidency of the Belgian Parliament is currently examining his extraordinary request. The president of the Senate, Ms Anne-Marie Lizin, already declared that it isn’t obvious: the obligations regarding the Senate and its members as set forth in the Constitution are independent from the salary-issue. It is not because a senator refuses his salary that he therefore could resign.Some newspapers and other political parties (CD&V) have already criticised Mr. Wilmots.
