US-Klage der 8./9. Boll Kino Beteiligungs GmbH & Co.KG (Fortsetzung)

12.Mai 2010: Erweiterung des bisherigen Klagantrages. Im Auftrag zahlreicher unabhängiger Filmstudios hat die US Copyright Group Klage gegen mehr als 20.000 BitTorrent-User eingereicht. Diese sollen Filmwerke der auftraggebenden Filmstudios illegal verbreitet haben. Darunter ist auch der deutsche Rechteinhaber 8./9. Boll Kino Beteiligungs GmbH & Co.KG.Wir verweisen insoweit auf den Blogeintrag vom 24.März 2010. Eine neue Art der Abmahnung, nur eben nun in den USA auf den Weg gebracht, zudem einträglicher ? Auf 89 Seiten werden Internet Protokoll Adressen aufgeführt, im nächsten Schritt (Discovery) wird man versuchen, auf die dahinter stehenden Namen der (Internet) Adressbesitzer zu kommen. Man kennt die Problematik aus deutschen Verfahren.

“Each Defendant is known to Plaintiff only by the Internet Protocol (“IP”) address assigned to that Defendant by his or her Internet Service Provider on the date and at the time at which the infringing activity of each Defendant was observed. The IP address of each Defendant thus far identified, together with the date and time at which his or her infringing activity was observed, is included on Exhibit A hereto. Plaintiff believes that information obtained in discovery will lead to the identification of each Defendant’s true name and permit the Plaintiff to amend this Complaint to state the same.
