am 21.03.2006 von http://www.strafprozess.chIn einem heute ergangenen Entscheid hat der U.S. Supreme Court (No. 04-1414 vom 21.03.2006) mit fragwürdiger Begründung und 8:0 Stimmen entschieden, dass die Ausstellung vorsorglicher Durchsuchungsbefehle (anticipatory warrants / Durchsuchungsbefehle ohne hinreichenden Tatverdacht, ohne probable cause) vor der Verfassung standhalte. Begründet wurde das Urteil ausgerechnet von Antonin Scalia, der sonst am Verfassungstext hängt wie kein anderer. Der Text (4th Amendment) lautet wie folgt:The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.Ein erster Kommentar von Crime & Federalism:Whatever his reasons, this case is utterly bizarre. Its one of the most poorly reasoned and disingenuous judicial opinions Ive seen in my lifetime. The next time someone proclaims the Power and Glory of Nino Scalia, Im going to ask them to reconcile Grubbs with any understanding of textualism.
