Okay, I’ll stay in the kitchen, i.e. I can take the heat (and my home office happens to consist - in its entirety - of a three-foot square area of my kitchen table). I’m not doing so well with my New Year’s resolution, so now it’s time to get back into the swing of things.
Yesterday, I had an interesting, albeit short exchange of comments about the ‘correct’ translation for “Rechtsanwalt” - in particular for a British audience. I may be going out on a limb here, but I thought I’d take some time to explore this topic.
Let’s start with some definitions:
Rechtsanwalt [-] 1. Der R. ist ein unabhängiges Organ der Rechtspflege und übt einen freien Beruf - kein Gewerbe - aus (§§ 1, 2 der Bundesrechtsanwaltsordnung - BRAO - vom 1. 8. 1959, BGBl. I 565 m. spät. Änd.); über Zusammenschluß mehrerer R. ->Sozietät, ->Partnerschaftsgesellschaft. Übergangsregelung für das Gebiet der ehem. DDR in Art. 21 des Ges. vom 2. 9. 1994 (BGBl. I 2278). Der R. ist der berufene Berater und Vertreter in allen Rechtsangelegenheiten (§ 3 BRAO, ->Rechtsberatung). Als RA wird durch dir LdJust-Verw. nur zugelassen, wer die Befähigung zum Richteramt erlangt hat (§ 4 BRAO). Der R. ist freizügig (§ 5 BRAO), muß aber bei einem bestimmten Gericht zugelassen sein und in diesen Bezirk eine Kanzlei einrichten (§§ 18, 27 BRAO); s.i.e. ->Zulassung zur Rechtsanwaltschaft.
