Quellenschutz im US Common Law?
am 11.02.2006 von strafprozessDer U.S. District of Columbia Circuit Court of Appeals hat über die Rechtmässigkeit der Verfügnug der Grand Jury gegen die New York Times-Journalistin Judith Miller zu entscheiden, welche sie verpflichtet hatte, Ihre Quellen preiszugeben (vgl. dazu meine früheren Beiträge, insb. hier). Findlaw fasst den Entscheid des Appellationsgerichts (02/06/06 - No. 04-3138, 04-3139, 04-3140) wie folgt zusammen: Neither the First Amendment nor the federal common law provides protection for journalists confidential sources in the context of a grand jury investigation. If any such common law privilege exists, it is not absolute.Damit gilt nach Common Law (vorerst) dasselbe wie in Zürich (vgl. dazu meinen früheren Beitrag).
