Freightforwarder not Liable for Patent Infringement

CK - Washington.   Under German patent law, specifically section 9 of the patent statute, an abetter may have to cease and desist from patent infringement and may be ordered to destroy infringing products. The federal supreme court decided that the definition of the abetter does not include a freight forwarder. In confirming a similar 1957 ruling, the court on September 17, 2009 ruled in the matter Xa ZR 2/08 in favor of a freight forwarder. Rechtslupe.de discussed the decision in German.
