FCC’s new policy regarding “fleeting expletives": arbitrary and capricious

Frisch vom US Court of Appeals for the Second Circuit: die Entscheidung in Sachen Fox v FCC (siehe zur Vorgeschichte hier und auch hier) betreffend das F- und S-Wort im (US-)Hauptabend-Fernsehen (unter anderem zum legendären Satz von Nicole Richie im Dialog mit Paris Hilton: "Have you ever tried to get cow shit out of a Prada purse? It’s not so fucking simple.") Das Gericht kommt zum Ergebnis, dass die FCC willkürlich ("arbitrary and capricious") vorgegangen ist, in dem sie jede Verwendung von "F-word" und "S-word" - auch als "fleeting expletives" - als unzulässig angesehen hat. Argumentative Unterstützung bekamen die Partygirls dabei indirekt durch Bush und Cheney - zum Beweis dafür, dass sich nicht jede Verwendung von F- oder S-Word auf “sexual or excretory organs or activities” bezieht, wie das die FCC sieht, wurden nämlich auch Zitate von von Präsident und Vizepräsident aufgeboten: Similarly, as NBC illustrates in its brief, in recent times even the top leaders of our government have used variants of these expletives in a manner that no reasonable person would believe referenced “sexual or excretory organs or activities.” See Br. of Intervenor NBC at 31-32 & n.3 (citing President Bush’s remark to British Prime Minister Tony Blair that the United Nations needed to “get Syria to get Hezbollah to stop doing this shit” and Vice President Cheney’s widely-reported “Fuck yourself” comment to Senator Patrick Leahy on the floor of the…
