Belgian Employers Face Reenforced Anti-Discrimination Squad
am 17.08.2005 von http://lawjustice.blogspot.comOn the one hand the Belgian government claims it wants to do everything to promote economic revival and to cut red tape (cfr. the Kafka-test), but on the other hand it recently enlarged the powers of the social inspectors who enforce the anti-discrimination law. At the end of the day, Belgian employers face an enlarged applicability of the anti-discrimination law combined with a reenforced anti-discrimination control. Before, an alleged victim of discrimination could not directly file a complaint with the social inspection but could ask the social inspectors to make a report about the alleged discrimination and to file this report at the public prosecutor’s office. The allegedly discriminated employee could then start legal proceedings according to common law (‘gemeen recht’).The Minister of Work extended the powers of civil servants of the social inspection (By a Royal Decree of 15 July 2005, published in the Belgian Gazette of 2nd August 2005). Now, the social inspectors (and technical experts, technical assistants) of the Ministery of Work (with pdf about how to file a complaint pursuant to the anti-discrimination law) can either after a complaint of an employee, but also themselves on their own initiative, so without complaint, investigate possible discrimination and racism on the work floor. In practice they often propose mediation, but if this fails the social inspectors can now make a warrant (‘proces verbaal’ or abbreviated ‘PV’) on the basis of which the employer can be criminally prosecuted.
